At trial issues of law and issues of fact are brought before the court. The court acts as a trier of fact, by a jury or a judge acting as a lone juror, to determine the truth of the evidences. The judge also rules on matters of law, and the application of the law is the basis for Appellate review. Admissibility of evidence, interpretation of statute, application of precedent, various intricacies of contractual rights, and the adherence to sentencing guidelines in criminal matters, are matters of law. Clients who believe that there are issues of law to be appealed should first gather all documents, preferably certified as to source - such as court documents, transcripts, and trial attorney's files. To provide an opinion the entire case must be reviewed. First to discover error, and then to assess whether the error caused an injustice. For instance, an error in admitting evidence is weighed against all other evidences as to its consequence in the determination of the court. This may prove substantial in both the determination of guilt or sentencing in a criminal matter. However, simple error may not overturn a conviction that was a fait accompli without the tainted evidence.
