Personal injury covers both person and property and requires proof of damages.

 Physical and emotional damages require medical documentation and opinion in order to be compensable. Valuable evidence can be developed in serious cases by video taping the victim and demonstrating the limitations as a result of injury.

Property damages require evidence of value, and its demise as a result of the injury. Purchase documents, title, insurance, and maintenance records authenticate ownership and contribute to a valuation prior to the time of the accident. Keeping these records current will assist you in gaining a fair appraisal. A photo of each side of the vehicle can provide evidence of good care.

A court may award three types of damages.

Special Damages consist of monetary damages as a result of injury. This includes repairs, rental cars, medical bills, loss of income, and legal fees and expenses.

General Damages cover personal insults such as "pain and suffering." While medical evidence of the insult is necessary for physical effects, the impact on a person's life can also be assessed by restrictions on activities even if only temporary. Clinical confirmation may be helpful but not entirely necessary. Giving up a hobby or sports activity while undergoing rehabilitation affects the enjoyment of life and may considered by the court.

Finally, there are Punitive Damages.  If gross negligence or unlawful activity is involved the court may determine that the defendant should be punished. This amounts to a civil fine for an egregious act. Missouri law provides that half of all punitive damages awarded must go to the State, making this less a bonanza for the plaintiff, though the penalty may satisfy the sense that justice was done.
